Speaker 1: So, a big question that a lot of Delawareans may have, is do you have to go to probate court when someone passes away? And the answer is, it depends.

It depends on how much they owe in the estate. How much they own, excuse me. So if the person passes away, owns at least $30,000, that’s 30,000 U.S. dollars in the estate, then the probate does have to be filed and opened. Also, if they owned any property, no matter what the property is worth, again, the estate has to be opened, whether they owned it solely or as a tenant in common.

So those are the two criteria. Again, I would ask an attorney or you can always call the county’s Register of Wills and ask them as well. But those are the two main criteria for whether probate court … you have to go to probate court when someone passes away.
